Online Class: Second Saturday Risk Management Class @ Zoom Online Class

On the Second Saturday of each month, we have a class for all levels of agents focussing on risk management and other legal issues. This month:

  1. You represent a buyer who wants to write an offer on a particular property. You did have them sign a Disclosed Limited Agency Agreement when you first started working with them. Then you get contacted by another buyer who wants to write an offer on the same property. You’re going to have them sign a DLAA too, but do you need to tell these buyers about each other?
    ⏹ Yes, because it’s DISCLOSED limited agency.
    ⏹ No, because you’re supposed to treat the activities of each client as confidential. That’s what the DLAA says.
    ⏹ Let’s talk about the conversation you documented with each buyer when they signed the DLAA.
  2. You represent a buyer who’s been put into backup position on a property. Since getting moved to first position is pretty iffy, they’ve continued to look at other properties.They’ve found one they want to write an offer on, but they don’t want to back out of the first offer until their second offer is accepted and they’ve had an inspection. Can they do this?
    ⏹ No, because that would not be bargaining in good faith with either seller.
    ⏹ Yes, so long as the second offer contains no undisclosed contingencies—the plan needs to be disclosed to the sellers.
    ⏹ What if the first property is not subject to the Property Disclosure law? Might your client end up obligated on two purchases with the intent and ability to close only one? What could have been done when your client agreed to be put in backup position to protect them?
  3. Speaking of the Seller’s Property Disclosure form, if a seller provides the form, but not all questions were answered, does the revocation period not begin until the buyer gets an answer to every question?
    ⏹ Yes, because the SPD must be “completed” by the seller which means answering every question.
    ⏹ No, the seller just has to hand over the form. How they “complete” it is up to them.
  4. What if every question was answered, but there’s an important update to one of the questions—does that restart the revocation period?
    ⏹ Yes
    ⏹ No
    ⏹ Maybe

To start out class, Erik Arevalo, Loan Workouts Specialist with First Tech Credit Union and an Oregon First, Realtors® agent will talk about what he’s seeing in the loan industry right now. This is not about people applying for loans—he does loan modifications and forbearances. They’re very busy right now, as you can imagine. I thought everyone could benefit from hearing what he’s experiencing and being able to ask questions of him.

Once everyone’s questions are answered, we’ll start going over the Commercial Sale Agreement. We’ve been talking a lot about working with investors lately, going over how to figure rates of return on investment properties and tenant rights, so a review of the Commercial Sale Agreement is in order. We’ll discuss only those parts that differ from the Residential Sale Agreement. Facebook Live Meeting: CARES Act & What it Means for Realtors® @ Zoom Online Class

The National Association of Realtors is hosting a Facebook Live event to go over the CARES act that was recently passed and how it will affect 1099 contractors. We’ve been getting a lot of questions about this, so we think this will be a popular event. CARES stands for Coronavirus Aid, Relief, and Economic Security and it has three main components:

  1. Unemployment insurance can now cover 1099 earners. It has also been increased by $600/week which in Oregon would be $985, I believe.
  2. The Economic Injury Disaster Loan (EIDL), which has always existed, now has an immediate $10,000 grant that will not have to be paid back—but no one as far as I can tell has actually gotten any money from it. Except for that initial grant, this is not a forgivable loan.
  3. The Payroll Protection Program or PPP which will provide a very low interest loan worth 2.5 times your average monthly payroll (and yes, you can count your own 1099 income), but the loan will be forgiven if you don’t fire any of your employees. I will be interested to hear more about how this works if you are your only employee. There are limitations on your ability to get money from both the EIDL and PPP programs.
Because we think this is going to be a class that interests a lot of people, we won’t be having our normal 10 AM Zoom meeting/class. But we can talk about what we learned Thursday morning.

Oregon First, Realtors® is starting up another Buffini group and thought we’d give everyone a bit of a teaser about what to expect. We will be running the introductory module this morning for everyone to watch for free.

This is a great time to take the 8 week course because it’s on sale for only $195. Normally, it’s about $400, so this is a great opportunity to take the course for HALF its usual price. If you like what you see and want to join the group, send an email to mickey@oregonfirst.com. If we get a lot of people wanting to do it, we can always start another group. We don’t want the groups to be too big, so it’s better to have more groups running more often than one big group.

Unusually for our classes, this one won’t earn credits, but we hope you find this introduction to the program useful. Our first Buffini group closed actual deals and got real money because of the work they did in this program, so the results were tangible and immediate.
